Ted W. Hight III

Ted W. Hight III is a member of the firm’s Bankruptcy and Creditors’ Rights practice groups. Mr. Hight concentrates his law practice on complex bankruptcy issues, receiverships, and related commercial and business litigation. His practice includes a wide range of industries including financial institutions, hospitality, manufacturing, real estate, retail and technology.

Mr. Hight regularly represents community banks, credit unions, finance corporations, landlords, lending institutions, liquidating trustees and Receivers appointed by Federal Courts and State Courts throughout the State of Georgia.In Bankruptcy matters, Mr. Hight primarily represents creditors in Chapter 11 cases in courts across the United States, as well as having participated in international proceedings.

Mr. Hight has served as lead counsel to financial institution clients in Chapter 11 reorganizations and pre-bankruptcy negotiations with defaulted borrowers. Mr. Hight routinely handles bankruptcy issues related to adequate protection, assumption/rejection of executory contracts and leases, automatic stay, cash collateral arrangements, contesting plans of reorganization, dischargeability complaints, preference and fraudulent conveyance actions, reclamation claims, valuation disputes, 363 sales, 503(b)(9) administrative claims, and other creditor issues.

Mr. Hight’s experience in commercial finance and secured transactions includes handling foreclosures of business assets and real estate (public sales, private sales, and Sheriff levies), assignments for the benefit of creditors, commercial collections, contract disputes, forbearance agreements, non-judicial liquidation arrangements, personal property foreclosures, and the recovery and protection of collateral.

Prior to joining Thompson, O’Brien, Kemp & Nasuti, P.C., Mr. Hight completed a pupilage with a preeminent real estate Barrister at the Royal Courts of Justice in London, England.

Mr. Hight resides in Johns Creek with his wife Stephanie and two sons. Mr. Hight is an avid participant in the Atlanta Amateur Hockey League and a parishioner at St. Brigid Catholic Church in Alpharetta.
